Wills and basic estate plans
All families should have wills and basic estate plans. Even if your main asset is a house, a basic estate plan will simplify the probate process and give your loved ones the peace of mind of knowing that your affairs are in order.
Estate plans are especially important for families with minor children, or with children who have special medical needs. In the sad event of both parents' deaths, a guardianship designation made in advance can greatly ease the process of determining who will care for the children.
At the Law Offices of Michael Sloan, we can write or review estate planning documents for you such as:
- A will, to designate the beneficiary or beneficiaries of your estate and to designate a guardian for minor children or adults with special needs
- An advance medical directive, which allows you to make decisions in advance about end-of-life medical care
- A durable medical power of attorney, which gives a trusted person the right to make medical decisions for you should you become incapacitated
- A durable financial power of attorney, which designates someone to make financial decisions on your behalf should you become incapacitated
Probate administration
Texas has two different types of probate proceedings: independent administrations, when a valid will exists; and dependent administrations, where no will exists or where all beneficiaries named in a will are disqualified from inheritance.
We offer experienced advice for those involved in either independent or dependent probate administration. In all cases, our goal is to help the probate process proceed smoothly, with minimal conflict, delay and expense.
